How Bail Bonds Work
A Bail Bond is simply a document provided by a surety or Bail Bondsman that guarantees the apperance of the defendant to the court where the defendant may have alleged charges.
Some Courts follow a bail schedule which sets a fee for a charge for example a 1st time DUI or DWI could be $1500.00 which would require the defendant to pay $150.00 to the Surety or Bail Bond Company.
Important Information
It is very important that you read your contract very carefully and understand completely what you are signing.
Some Bail Bondsman may require you to place a lien against your property as a guarantee for the defendant and payment of the premium.
We have seen over the years that this might be catastrophic for the cosigner if there is a breach of contract or even a late payment.
Appearance & Exhaneration
A Bail Bond is guarantying the appearance of the defendant until sentencing or the charges are dismissed.
The Co-signer is signing also a guarantee with the surety or bail bond company that the defendant will make all court dates.
If the defendant fails to appear (FTA) the court date the court may issue a warrant of arrest for the defendant.
The Co-signer then becomes responsible for the costs to apprehend or secure the defendant back in custody.
This can be very costly and may jeopardize the collateral that has been posted with the surety.
Bail Enforcement laws are very different than law enforcement and can be subject to interpretation they vary state to state.
Reasonable Bail Set
It can be very advantageous to work with the criminal defense attorney to get a reasonable bail set that correlates with the charges.
At times it pays off to have patience and work closely with the attorney.
The bail is set based upon flight risk, the charges at hand, and the threat to the community.
This is a conversation that your attorney will have with the prosecutor and the judge.
How to Choose a Bail Bond Company
Th old saying “if something seems to be good to be true” is a good moto to go by.
A good Bail Bond Company will usually be understandable of your situation and some will work with you financially as you may be forced to come up with attorney fees as well as the bail premium.
As stated before you should always read your bail documents really closely to see what you are getting yourself into.
The state insurance dept. can also be a good resource to see if the bail company has had any complaints ect.
